Kerangka Hukum untuk Ekonomi Sirkular: Identifikasi Kebijakan Tata Kelola Limbah dan Kesenjangan Daya Tahan di Indonesia

Abstract


This study examines the limitations of Infonesia’s governance framework in fully integrating circular economy principles, particularly regarding product durability upstream sustainable measures. While existsing regulations emphasize downstream waste management, the absence of explicit durability and eco-design obligations reflects a structural regulatory gap. This research was a normative legal research, with comparative and conceptual approach, examining key Indonesioan regulations on waste management, environmental protection and industrial production. The findings reveal that Indonesia’s regulatory system has institutionalized the 3R principles through mandates on waste management, environmental standards, adn producer responsibility. However, the framework remains predominantly reactive, focusing on end-of-pipe solutions, with limited integration of upstream interventions such as eco-design, repairability, and durability standards. Comparative analysys demonstrates that jurisdictions incorporating durability obligations achieve grater waste reductions and reseource efficiencey. The study concludes that despoite its comprehensive scope, Indonesia’s regulatory framework requires upstream legal reform to address durability gaps and ensure alignment with circular economy principles.
