PELAKSANAAN FATWA DSN-MUI NOMOR 86/DSN-MUI/XII/2012 TENTANG HIBAH DALAM PENGUMPULAN DANA LEMBAGA KEUANGAN SYARIAH PADA PRODUK SI WADIAH DI BMT SRIKATON

Abstract

BMT Srikaton, which is in Bengkulu province, has one of its superior products, namely Si Wadiah. This product uses a wadiah contract, where LKS can give bonuses to members. At BMT Srikaton, the bonus is in the form of prizes which are distributed by drawing. In this regard, there are provisions regarding the giving of gifts which are contained in the DSN-MUI fatwa Number 86/DSN-MUI/XII/2012 concerning Prizes in Fundraising for Sharia Financial Institutions. This study is intended to answer the problems: (1) What is the mechanism for giving prizes at BMT Srikaton for Si Wadiah products? (2) How is the implementation of the DSN-MUI fatwa Number 86/DSN-MUI/XII/2012 concerning Prizes in Fundraising for Sharia Financial Institutions at BMT Srikaton? These problems were discussed through field studies/research carried out at BMT Srikaton. The data obtained was carried out by means of interviews and documentation. This research uses qualitative analysis techniques (descriptive analytical). The results of this research are: (1) The mechanism for giving prizes at BMT Srikaton for Si Wadiah products uses the wadi'ah yad dhamanah contract, with a bonus whose percentage cannot be determined. The bonus is not given every month, but is given on the 25th month in the form of prizes which are distributed by drawing. The terms and conditions for this product are being a member of BMT Srikaton, paying administration fees, carried out in groups (one group has 100 members), and a savings period of 24 months. (2) Implementation of DSN-MUI fatwa Number 86/DSN-MUI/XII/2012 concerning Prizes in Fundraising for Sharia Financial Institutions at BMT Srikaton, there are several provisions that are appropriate and inappropriate.
