Reinterpretasi QS. Al-Baqarah: 221 dan 232 Tentang Wali Nikah Perspektif Teori Hudud Muhammad Syahrur
Abstract
This research examines the reinterpretation of Surah Al-Baqarah verses 221 and 232 related to marriage guardians from the perspective of Muhammad Syahrur's hudud theory. Syahrur's hudud theory offers a dynamic perspective on the application of Islamic law, particularly in respecting women's rights and decisions in marriage. This approach emphasises the importance of adapting the law to the times and protecting women's autonomy without pressure or domination from other parties. In the Indonesian context, the existence of a marriage guardian is relevant and explicitly regulated in the Compilation of Islamic Law (KHI) as one of the mandatory pillars of marriage. However, the role of the guardian here is not interpreted as a form of coercion or domination, but rather as a means of protecting and safeguarding women's rights and interests under Sharia. Thus, Syahrur's hudud theory and the practice of marriage guardianship in Indonesia complement each other. Shahrur's theory strengthens the spirit of respect and autonomy of women. At the same time, the practice of guardianship in Indonesia serves as a guardian of legal validity and protector of women's rights in marriage. Both are important to create a balance between legal validity, protection of women's rights, and adaptation to the dynamics of modern society.
