ANALISIS HUKUM ISLAM TERHADAP HYBRID KONTRAK PADA SEKTOR EKONOMI DIGITAL

Abstract

This research aims to analyze the application of Islamic law to hybrid contracts in the digital economy sector. Hybrid contracts, which are a combination of various traditional contract elements with digital transaction technology and mechanisms, are increasingly being used in digital economic transactions. However, there are challenges in assessing the validity and conformity of these contracts with the principles of Islamic law, which prioritize justice, transparency and legal certainty. In this research, a qualitative approach is used to explore Islamic legal perspectives on various types of hybrid contracts, such as online sales and purchase contracts, rental contracts, and other agreements involving technology and digital elements. The research results show that although some aspects of hybrid contracts are acceptable in Islamic law, there are several things that need to be considered, such as elements of gharar (uncertainty) and riba (interest) that can appear in digital transactions. Therefore, it is recommended that there be more in-depth regulatory adjustments and development to ensure that digital contracts remain in accordance with sharia rules. This research contributes to understanding the application of Islamic law in facing contractual challenges in the digital era, as well as providing recommendations for business practices that are more sustainable and in accordance with sharia principles.
