TINJAUAN HUKUM EKONOMI SYARIAH TERHADAP PRAKTIK JUAL BELI MAKANAN DENGAN KONSEP ALL YOU CAN EAT (STUDI DI RESTORAN KENZEA CULINARY KOTA BENGKULU)

Abstract


The all you can eat concept is where customers (buyers) can choose their own food to their heart's content. As is known, all you can eat restaurants provide unlimited food for one payment without measuring or weighing the food to be bought and sold. This research examines: (1) What is the practice of buying and selling food with the all you can eat concept at the Kenzea culinary restaurant in Bengkulu City? And (2) What is the practice of buying and selling with the all you can eat concept in the review of sharia economic law? This research uses a qualitative research method which is a type of field research, in the form of interviews with restaurant managers and customers of the Kenzea Culinary Restaurant. The results of the research that the author has conducted show that (1) The all you can eat system at the Kenzea Culinary Bengkulu restaurant is a system where customers can eat all the food available to their heart's content with just one price and one payment. Customers are only given a time limit of 190 minutes, and must not leave a large amount of food (more or less a full plate of food), (2) According to the scholar Sheikh Shalih Al Fauzan, he believes that buying and selling food using the all you can eat system is haram, because In this transaction there is an element of gharar (unclarity). Meanwhile, according to Sheikh Ibnu Utsaimin who said that although there are elements of gharar, the gharar is gharar yasir (light gharar) which can be tolerated by society because there is no harm to other parties.
