IMPLEMENTASI KEPMEN ESDM NOMOR 37 TAHUN 2023 TENTANG PERTUNJUKAN TEKNIS PENDISTRIBUSIAN ISI ULANG LIQUEFIED PETROLEUM GAS TERHADAP PRAKTIK JUAL BELI GAS LPG 3 KG DALAM PERSPEKTIF HUKUM EKONOMI SYARIAH (STUDI DI KELURAHAN PAGAR DEWA KOTA BENGKULU)

Abstract

The problems in this research are, (1) How is the Implementation of Minister of Energy and Mineral Resources Decree No. 37 of 2023 concerning Technical Instructions for the Distribution of LPG Refills in the Practice of Buying and Selling 3 Kg LPG Gas in Pagar Dewa Village, (2) How to Implement ESDM Ministerial Decree No. 37 of 2023 concerning Technical Guidelines for the Distribution of 3 Kg LPG Refills in the Perspective of Sharia Economic Law. To answer the above questions, researchers used research methods. This research is a type of field research. The approach to this research is a descriptive qualitative approach which is used to obtain data in the form of information and facts about the practices of buying and selling 3 kg LPG gas that apply in society. The results of this research show that (1) Implementation of Minister of Energy and Mineral Resources Decree No. 37 of 2023 in the practice of buying and selling 3 Kg LPG gas in Pagar Village has implemented a by name by address system, then the base party will carry out registration based on the identity card into a special application. Once registered in the application, then consumers can buy 3 kg LPG gas. (2) Based on the perspective of Sharia Economic Law, the practice of buying and selling 3 Kg LPG gas in Pagar Dewa Village has fulfilled the pillars and conditions. In this regard, it has been studied based on KHES which states that a valid contract is a contract that fulfills the pillars and conditions, so in practice what has been done is legally permissible and valid.
