ANALISIS AKAD RAHN TERHADAP PRAKTIK GADAI TANAH PERKEBUNAN

Abstract


Pawn according to the fiqh scholars is to make something important as security for an obligation. In fact, providing obligations is a wise act to help people who are in a state of need and do not have cash in the form of real money. the issues discussed. How is the implementation of the Rahn contract on the plantation land that has been mortgaged but re-mortgaged, then what is the perspective of Sharia Economic Law on the Rahn contract on the rice field that has been mortgaged but remortgaged by the murtahin. Researchers use field research methods and this research is a type of qualitative research. Data collection is done by observation, interview, and documentation. Based on the results of the analysis, the implementation of pawn leasing of plantation pawn land is not valid because the re-pawned garden cannot be taken advantage of by leasing the garden back to third parties. The pawn agreement that occurred between rahin and murtahin was in accordance with Sharia Economic Law regarding Rahn, then here murtahin leased the rice fields back to the third party with an agreement agreed between the three, but there was an irregularity that the landowner or rahin asked for a fee for his rice field land which was leased to the third party which then the rahn contract that occurred between the two.
