Implikasi Kertoaji sebagai Pendekatan Tradisional dalam Pembagian Warisan terhadap Hubungan Kekeluargaan di Desa Sananrejo, Kecamatan Turen, Kabupaten Malang, Jawa Timur

Abstract

The practice of inheritance distribution plays a crucial role in maintaining family harmony and social stability. This study aims to analyze the traditional inheritance distribution method in Sananrejo Village, Turen District, Malang Regency, through the "Kertoaji" approach, which converts inherited assets into monetary value based on family consensus. Using a descriptive qualitative approach, data were collected through in-depth interviews with village officials, such as the Modin, and direct observation of local community dynamics. Thematic analysis was applied to identify patterns and influencing factors in the practice. The findings show that the "Kertoaji" approach is effective in reducing potential conflicts among heirs and preserving familial relationships. However, it faces challenges due to the community's limited understanding of Islamic inheritance law (faraidh), often leading to the neglect of true justice principles. Village officials play a key role as mediators, although they are not always able to overcome individual ego and pride. In conclusion, while the "Kertoaji" method offers a pragmatic local solution, continuous education on Islamic law is needed to achieve more substantive justice and sustainable social harmony.
